PERTANGGUNGJAWABAN NEGARA TERHADAP PENYALAHGUNAAN HAK KEKEBALAN DIPLOMATIK DITINJAU DARI KONVENSI WINA 1961 (Studi Kasus Penyadapan Australia Terhadap Indonesia)

Penelitian ini bertujuan untuk mengetahui dan mengkaji pengaturan hukum yang terdapat dalam Konvensi Wina 1961 yang berkaitan dengan penyalahgunaan hak kekebalan diplomatik terhadap kasus penyadapan yang dilakukan oleh Australia di Indonesia serta untuk mengetahui dan mengkaji pertanggungjawaban negara terhadap penyadapan yang dilakukan Australia terhadap Indonesia. Terkait jenis penelitian yang digunakan adalah jenis penelitian hukum normatif, sehingga pendekatan yang digunakan yaitu pendekatan perundang-undangan, pendekatan konseptual, serta pendekatan kasus. Adapun sumber bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan bahan hukum yang digunakan dengan teknik deskriptif dan teknik argumentasi serta diuraikan secara sistematis terhadap permasalahan yang dihadapi. Adapun hasil penelitian ini menunjukkan bahwa 1) Adanya aturan hukum yang dilanggar terkait penyadapan yang dilakukan Australia terhadap Indonesia yang diatur dalam pasal 3 ayat 1 huruf (d), pasal 27 ayat 1 serta pasal 41 ayat 1 Konvensi Wina 1961, 2) Adanya pertanggungjawaban yang harus dipenuhi pihak Australia terhadap penyalahgunaan hak kekebalan diplomatik dalam Konvensi Wina 1961 terkait kasus penyadapan yang dilakukan di Indonesia. Pertanggungjawaban yang dilakukan dengan cara penyelesaian sengketa secara damai atau negosiasi dengan pembentukan protokol Code of Conduct (CoC) on framework for security coorperation berdasarkan prinsip kesepakatan bersama (mutual consent).
