PERLINDUNGAN HUKUM TERHADAP ANAK KORBAN PENYALAHGUNAAN NARKOTIKA DI KABUPATEN KLUNGKUNG

Penelitian ini bertujuan (1) Untuk mengetahui dan mengkaji bentuk perlindungan hukum yang ditegakkan terhadap anak korban penyalahgunaan narkotika di Kabupaten Klungkung (2) Untuk mengetahui hambatan dalam memberikan perlindungan hukum bagi anak penyalahgunaan narkotika di Kabupaten Klungkung. Adapun jenis penelitian yang digunakan adalah penelitian hukum empiris, dengan sifat penelitian deskriptif dengan lokasi penelitian dilaksanakan di Polres Klungkung , dan BNNK Klungkung. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah dengan teknik studi dokumen, wawancara, dan observasi. Teknik penentuan sampel yang digunakan yakni teknik Non Probability Sampling serta penentuan subjeknya menggunakan teknik Purposive Sampling. Teknik pengolahan dan analisis data digunakan secara kualitatif. Berdasarkan hasil penelitian menunjukkan bahwa (1) dalam memberikan perlindungan hukum terhadap anak korban penyalahgunaan narkotika di Kabupaten Klungkung ada 2 (dua) bentuk perlindungan hukum yang diterapkan yakni perlindungan hukum preventif berupa sosialisasi ke tempat yang dianggap sering terjadi penyebaran narkotika dan perlindungan hukum represif berupa rehabilitasi yang dilakukan oleh pihak BNNK Klungkung. (2) Dalam memberikan perlindungan hukum tentu ada hambatan yang terjadi yakni : sulit mengajak korban untuk rehabilitasi, kurangnya kesadaran masyarakat dengan adanya hukum, korban yang tidak mau berkata jujur saat memberikan informasi, dan sarana dan prasarana yang terbatas.
