PENYELAMATAN DAN PENYELESAIAN HUKUM KREDIT MACET ATAS PEMBERIAN MODAL USAHA MIKRO KECIL MENENGAH DI PT PERMODALAN NASIONAL MADANI MEKAAR SERIRIT

Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis mekanisme penyaluran kredit dan upaya penyelamatan dan penyelesaian hukum kredit macet atas pemberian modal usaha mikro kecil menengah yang disalurkan oleh PT Permodalan Nasional Madani Mekaar Seririt. Jenis penelitian yang digunakan adalah penelitian hukum empiris dengan sifat penelitian deskriptif. Penelitian ini dilakukan di PT Permodalan Nasional Madani Mekaar Cabang Seririt, Area Buleleng 2 yang pengumpulan datanya dilakukan dengan teknik studi dokumen, observasi, dan wawancara. Teknik penentuan sampel yang digunakan adalah teknik Non Probability Sampling dengan menggunakan teknik Purposive Sampling dalam penentuan subjek penelitian, dan selanjutnya data diolah menggunakan kata-kata atau secara kualitatif. Adapun hasil penelitian menunjukkan bahwa: 1) Sistem pemberian kredit modal Mekaar disalurkan tanpa adanya agunan. Ada pun dua produk yang ditawarkan yaitu produk pembiayaan dan produk tabungan. Sistem pemberian modal Mekaar terdiri atas pencarian nasabah, penyesuaian syarat dan ketentuan, latihan pembiayaan, pencairan dana, dan model angsuran. 2) Upaya yang dilakukan PNM Mekaar Seririt dalam menyelamatkan kredit bermasalah atau macet yaitu dengan upaya preventif mengacu terhadap prinsip 6C. Upaya lainnya yaitu dengan mengimplementasikan sistem tanggung renteng dan menempuh upaya alternatif secara rescheduling, reconditioning, dan restructuring. Ada pun upaya penyelamatan yang bisa dilakukan dengan berpedoman terhadap KUH Perdata yaitu dengan pemberian somasi, penyelamatan melalui jaminan umum, dan gugatan ke pengadilan.
