PENJATUHAN PIDANA TERHADAP PELAKU TINDAK PIDANA PROSTITUSI ONLINE (STUDI KASUS PUTUSAN NOMOR 6/PID.R/2018/PN.BJB)

Penelitian ini bertujuan untuk (1) mengetahui pengaturan tindak pidana prostitusi online di Indonesia, serta (2) menganalisa pertimbangan hukum terhadap penjatuhan pidana tindak pidana prostitusi dalam Putusan No. 6/Pid.R/2018/PN.BJB. Jenis penelitian yang digunakan adalah penelitian hukum normatif. Jenis pendekatan yang digunakan adalah pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Analisis data dilakukan secara kualitatif dengan cara menguraikan data dalam bentuk kalimat runtun dan logis. Hasil penelitian adalah (1) pengaturan prostitusi online tidak diatur secara jelas dalam peraturan perundang-undangan namun pengaturan tentang pelaku prostitusi tersirat dalam Pasal 296 KUHP yang menentukan pemidanaan hanya dikenakan bagi orang yang menggunakannya sebagai mata pencaharian. Kemudian (2) pertimbangan hukum dalam menjatuhkan Putusan No. 6/PID.R/2018/PN.BJB adalah keterangan para saksi yang mendukung tindakan terdakwa yang telah melakukan praktek pelacuran dengan imbalan sebesar Rp. 80.000,- sehingga tindakan terdakwa termasuk telah menyakinkan bersalah melakukan tindakan prostitusi sehingga dikenakan Pasal 3 Ayat (1) hurup b Peraturan Daerah Kota Banjar Baru No. 6 Tahun 2002 Tentang Pemberantasan.
