IMPLEMENTASI UNDANG-UNDANG PERKAWINAN DALAM PELAKSANAAN PERKAWINAN ADAT DI DESA ADAT BULELENG

Penelitian ini bertujuan untuk (1) mengetahui tata cara pelaksanaan perkawinan adat yang dilakukan menurut hukum adat di Desa Adat Buleleng, dan untuk mengetahui (2) syarat perkawinan menurut Undang-Undang Nomor 1974 dalam Perkawinan Menurut Hukum Adat di Desa Adat Buleleng. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum empiris. Lokasi penelitian ini dilakukan di Desa Adat Buleleng. Teknik pengumpulan data dengan menggunakan teknik studi dokumen dan wawancara. Teknik pengolahan dan analisis data secara kualitatif. Hasil penelitian menunjukkan bahwa (1) Tata cara pelaksanaan perkawinan menurut Hukum Adat di Desa Adat Buleleng adalah sebagai berikut: Pihak keluarga laki-laki mengadakan penjantosan (menyantosin), Pihak laki-laki melakukan peminangan, Upacara widhi widana, .Upacara Mejauman/mebebasan juga disebut dengan “ngabe tipat bantal”. (2) Mengenai syarat perkawinan menurut Undang-Undang Nomor 1974 dalam Perkawinan Menurut Hukum Adat di Desa Adat Buleleng secara umum dilakukan melalui pelibatan prajuru desa adat, perangkat desa dinas, dan pegawai pencatat perkawinan, tetapi tata cara pelaksanaan perkawinan yang dilaksanakan belum menjalankan proses pengumuman, sehingga pemenuhan syarat perkawinan tidak melibatkan masayarakat banyak/umum.
